Terms of Service

These Terms of Service ("Terms") govern your access to and use of AppMetricsKit (the "Service"), a privacy-first mobile app analytics platform operated by AppSurge, Belgium. By creating an account or using the Service you agree to these Terms.

1. The Service

AppMetricsKit lets you collect pseudonymous analytics events from your mobile apps and view dashboards, funnels, retention, subscription, and privacy reports. We provide SDKs and an ingest API for sending events. The Service is intended for indie developers, companies, and agencies building or operating mobile applications.

2. Accounts and organizations

You are responsible for the activity of your organization and its members, and for keeping ingest keys and credentials confidential. Roles (Owner, Admin, Developer, Analyst, Billing, Read-only) determine what each member may do.

3. Acceptable use

• Do not send personal data that our platform is designed to avoid (emails, phone numbers, names, advertising IDs, raw account IDs, precise GPS, or payment card data).
• Do not attempt to re-identify pseudonymous end users.
• Do not abuse, overload, or attempt to bypass rate limits or quotas.
• Do not use the Service for unlawful purposes.

4. Plans, usage, and billing

Paid plans are billed by monthly event volume. Usage above your plan limit may be billed as overage or limited according to your plan. Fees are non-refundable except where required by law. You may cancel a paid subscription at any time; cancellation takes effect at the end of the then-current billing period unless the checkout or customer portal says otherwise.

5. Data ownership

You retain ownership of the analytics data you send. You grant us a license to process it solely to provide the Service. Our handling of data is described in our Privacy Policy.

6. Availability and changes

We operate the Service on a best-effort basis and do not provide a service-level agreement unless we separately agree one in writing. The Service is provided "as is." We may modify or discontinue features with reasonable notice.

7. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. On termination you may export your data for a reasonable period before deletion.

8. Limitation of liability

To the maximum extent permitted by law, AppMetricsKit is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

9. Governing law

These Terms are governed by the laws of Belgium, without regard to conflict-of-law rules.
